No, Windmill Farms is not a City.
Windmill Farms is within several special districts which provide many different services comparable to a city. For example, Windmill Farms lies entirely within the boundaries of the Kaufman County Fresh Water Supply Districts ("KCFWSDs") and Severn Trent. These entities are Political Subdivisions of the State of Texas and have different kinds of taxing authorities similar to a city.
These Districts went through a creation and approval process as required by Texas statutes and were approved by the Kaufman County Commissioners Court. The Fresh Water Supply Districts provide more than "Fresh Water." Among other things, these Districts construct and maintain water, sanitary sewer service, storm drainage, roads and trash removal in addition to providing inspections for the construction of new homes within the boundaries of Windmill Farms. FWSD is a limited taxing authority which approved a ½ cent sales tax to be collected upon future retail sales.
All property owners within the boundaries of Windmill Farms are subject to these districts. Generally, property owners are subject to an ad valorem (property) tax separately imposed by their respective Fresh Water Supply Districts and collected by the Kaufman County Tax Assessor Collector. The current master plan for the Windmill Farms community will encompass approximately 3852 acres located in unincorporated Kaufman County, midway between Forney and Terrell.
Among other services, the KCFWSDs provide water, wastewater, and trash removal services within the boundaries of Windmill Farms. Water for Windmill Farms is currently obtained from two sources - onsite wells and water from the City of Forney. The original source of water for the community comes from two deep wells located within the boundaries of Windmill Farms. In 2004 KCFWSD 1-A and the City of Forney entered into an agreement to acquire surface water from the North Texas Municipal Water District. This line was recently completed. Wastewater treatment facilities for the community are currently located within the boundaries of the District. KCFWSD and the City of Forney entered into a letter of understanding concerning the wastewater discharge from Windmill farms, and, in the future, it is anticipated that Windmill Farms wastewater will be treated by North Texas Municipal Water District at an offsite, regional facility.
Severn Trent Services is under contract to operate, maintain and manage the Facilities owned by KCFWSD for the purpose of providing water, wastewater and ancillary services to property owners within Windmill Farms. The facilities are permitted and operated under the auspices of the Texas Commission on Environmental Quality (TCEQ). The facilities are inspected and tested frequently, and reports are filed with TCEQ in compliance with the rules and regulations that apply to all public water and wastewater utilities in the State of Texas. All water supplied to Windmill Farms homeowners is frequently tested at various control points within the community. Severn Trent works with the TCEQ to address all state and federal requirements affecting the water supply.

Windmill Farms is served by the highly acclaimed Forney Independent School District. Forney Independent School District is a TEA "Academically Acceptable" School District. Currently Windmill Farms residents attend the following campuses:
Early Childhood, Kindergarten, Grades 1-6th
Since the 2004 Fall term, elementary school children residing in Windmill Farms attended a new school (Blackburn Elementary) located at the southwest corner of Concorde Drive and Irongate Blvd. The 16 acre school site was donated by the developers of Windmill Farms to the Forney Independent School District.
Early Childhood, Kindergarten, Grades 1-6th
Smith Elementary School opened Fall 2008 for school children residing in Windmill Farms. It is located on Irongate Blvd.
Grades 7th and 8th
Forney Independent School District purchased 35 acres in Windmill Farms between Phase 1 and Phase 2 and adjacent to the Windmill Farms Boulevard. The new Brown Middle School opened for the Fall 2006 school year.

As a homeowner you will pay an ad valorem (property) tax to Kaufman County and Forney Independent School District. There are NO City property taxes for Windmill Farms. Instead as a property owner in Windmill Farms, you will pay to KCFWSDs an ad valorem tax at a rate that depends upon the location of your home within Windmill Farms based upon an assessed value established by the Kaufman County Appraisal District and approved by the Kaufman County Commissioner's Court. The KCFWSDs property taxes are used to pay the costs to construct and maintain the water and waste water plants and infrastructure, storm drainage and roads.

Fiscal year 2005 Ad Valorem (property) tax rates
Property taxes (ad valorem taxes) are due to be paid to the Kaufman County Tax Assessor-Collector by January 31st of each year. Most mortgage lenders create an escrow account on your behalf and collect 1/12 of the property taxes and hazard insurance each month in your mortgage payment, then pay your taxes and insurance premiums when they are due. When buying a new home in any community, you should use the new home purchase price as the estimated assessed home value to project your property tax bill.
A portion of the property taxes (ad valorem taxes) are assumed by the new property owner at the time of closing. Property taxes are customarily prorated between the buyer and the seller based upon the number of days each holds title to the property during the year.
Yes, Windmill Farms homeowners are automatically a member of the HOA. Membership is mandatory.
Windmill Farms Homeowner's Association is a non-profit corporation that has enforcement rights for the Deed Restriction (otherwise know as the Declaration of Covenants, Conditions and Restrictions) and has maintenance responsibility for the landscaping, greenbelts, parks and open areas in addition to the pavilions and swimming centers.
The purpose of a Homeowner's Association is to help preserve property values by creating overall architectural controls, design guidelines and deed restrictions and to enhance the quality of life for all Windmill Farms residents in addition to the maintenance of common areas and community facilities.
Windmill Farms HOA dues per calendar year: $473.00
The HOA Deed Restrictions require HOA dues to be paid bi-annually due on or before January 31 and on or before May 1. The annual dues and timing of payment are set by the HOA Board of Directors. Today, the board of directors has permitted dues to be payable semi-annually; 1/2 on or before January 31 and the second 1/2 on or before May 1st.
